They apply to all flights departing from an EU airport, regardless of whether the airline is based in the EU or outside the EU. The Court of Justice of the European Union has repeatedly ruled that a routine technical malfunction discovered during maintenance is part of the inherent risk of air travel (Wallentin-Hermann case).
